The law creares a new caregory ofpower producers, called exempr wholesale generarors (EWGs). By exempring EWGs from PUHCA regulacion, ehe law has eliminated a major barrier for uriliry-affıliared on non-affiliared power producers who wanr to compere ro build new non-rate-based power plants . These EWGs will differ from PURPA QFs in rwo ways. First, rhey will not be required ro meet PURPA's cogenerarion or renewable fuels limirarions. Second, uriliries will not be required ro purchase power from EWGs. The law is being haileci as ehe mosr significant piece of energy legislation since the 1970s. In addition to giving EWGs and qualifying faciliries ehe opporrunicies ro obrain access ro disranr wholesale markets, the new law also provides transmission-dependenc utilities the ability to shop for wholesale power supplies and frees these utilities, mosdy municipal utilicies ancl rurnl cooperatives, from cheir dependency on surrounding invesror-owned urilities forwholesalepower reguirements. TheU.S. electric utility communiry is now in a debare over how rhis new access to invesror owned transmission gricls will be regulared and cosred.
